Class Action Settlements for Employees and Job Applicants

Workplace settlements are easy to miss: the notice goes to whatever address your old employer had on file. Here's what's open for current and former employees, and even people who only applied.

Employment settlements are some of the best-paying class actions, because they repay wages or retirement savings rather than a small share of a consumer fund. They're also the ones people miss most often. The notice is mailed to the address your employer had on file, which for a job you left years ago is probably wrong.

Five kinds of workplace settlements

  1. 1Unpaid wages and overtime. Off-the-clock work, misclassification as exempt, tip-pool violations, missed meal breaks. Many of these pay automatically based on payroll records.
  2. 2401(k) and pension fees. ERISA cases claim a plan paid excessive fees or kept poor investments. Current participants are usually paid straight into their accounts; former employees may get a check or rollover.
  3. 3Biometric time clocks. Illinois's BIPA law requires written consent before an employer scans your fingerprint or face. Workers clocked in that way without consent have won large settlements. See Illinois-only settlements.
  4. 4Job postings without pay ranges. Since 2023, Washington has required job ads to list a pay range and benefits. People who applied to postings that didn't can claim, even if they never got the job. See Washington-only settlements.
  5. 5Mass layoffs. The federal WARN Act requires 60 days' notice before large layoffs or plant closings at employers with 100 or more employees. Settlements repay the wages workers would have earned during the missing notice period.

Claiming against a current employer

Federal and state wage laws prohibit retaliation against employees for taking part in a class action, and the settlement administrator, not your employer, processes the claims. Many workplace settlements pay without any claim form at all; the most important step is making sure the administrator has your current address.

Former employees: update your address

If a settlement covers a job you've left, contact the administrator listed on its page and give them your current mailing address and email. Uncashed and undeliverable checks are the most common reason workers never see their share.

Add your current and past employers as brands in SettleScout. The app flags new workplace settlements for them and reminds you before each deadline.

Frequently Asked Questions

Can my employer fire me for joining a class action?

Federal and state wage laws prohibit retaliation against workers who take part in wage claims, and claims are processed by an independent administrator. If you're worried about a specific situation, an employment lawyer can advise you.

I only applied for the job. Can I really claim?

For Washington's job-posting pay-range cases, yes: the law protects applicants, so the class is people who applied to postings that left out the pay range, whether or not they were hired.

Do I have to file a claim for a 401(k) settlement?

Usually not. ERISA settlements typically allocate money automatically to current and former plan participants based on their account balances. Former participants sometimes need to choose between a check and a rollover.
