About This Settlement

Travelers Insurance has agreed to a class action settlement to resolve claims that it misled New Mexico policyholders about underinsured motorist (UIM) coverage.

The Travelers Insurance settlement benefits New Mexico policyholders who had UIM coverage with Travelers Insurance between Jan. 1, 2015, and Aug. 16, 2022.

Plaintiffs in the class action lawsuit accused Travelers of selling misleading UIM coverage to New Mexico policyholders. The plaintiffs claimed Travelers failed to explain that it would apply an offset against UIM coverage based on the at-fault driver’s insurance coverage.

Travelers is an insurance company that offers a variety of policies, including auto insurance.

Travelers has not admitted any wrongdoing but agreed to pay an undisclosed sum to resolve the class action lawsuit.

Under the terms of the Travelers Insurance settlement, class members can receive either a premium refund or a claim re-evaluation.

Premium refunds will return 29% of all UIM premiums paid by class members during their insurance coverage with Travelers.

Claim re-evaluations will adjust UIM claims without applying the offset that was previously applied. This could result in class members receiving additional UIM benefits.

The deadline for exclusion and objection is June 29, 2026.

The final approval hearing for the Travelers Insurance settlement is scheduled for July 29, 2026.

To receive settlement benefits, class members must submit a valid claim form by Sept. 27, 2026.

Claimants must provide their policy number, date of loss and claim number, if known.
