Costa Del Mar Inc. agreed to pay $21.75 million to settle a class action lawsuit alleging it misrepresented its “nominal fee” repair promise and charged consumers more than a nominal fee to repair sunglasses damaged by accident, normal wear and tear, or misuse. The plaintiff also claimed Costa failed to disclose these repair charges at the time of purchase, on its website or over the phone before customers mailed in their sunglasses at their own expense.
There is a separate Costa Del Mar settlement for non-Florida residents and another over warranty fees.
